Our Response Process
Upon receiving a valid DMCA notice, we will:
- Remove or disable access to the allegedly infringing material
- Notify the user who posted the content
- Provide the user an opportunity to file a counter-notification
- If a valid counter-notification is received, notify the original complainant
- Restore the content within 10-14 business days unless the complainant files a court action
Repeat Infringer Policy
INeedaBeat maintains a strict repeat infringer policy. Users who repeatedly infringe copyrights will have their accounts terminated. Our policy includes:
- First offense: Warning and content removal
- Second offense: 30-day account suspension
- Third offense: Permanent account termination
We reserve the right to terminate accounts immediately for egregious violations.
Content ID & Prevention
INeedaBeat employs audio fingerprinting technology to help prevent copyright infringement:
- Beats are fingerprinted upon upload to detect duplicates
- Automated scanning compares new uploads against known copyrighted works
- Suspicious content is flagged for manual review
- Verified producers can register their catalog for additional protection
Sample Clearance
Beats containing samples must have proper clearance before being listed for sale. Producers are responsible for:
- Obtaining necessary sample clearances before upload
- Disclosing sample usage in beat descriptions
- Providing clearance documentation upon request
Uncleared samples put both producers and buyers at legal risk. We encourage the use of royalty-free samples or original compositions.
Fair Use
We recognize that certain uses of copyrighted material may constitute fair use under copyright law. Factors we consider include:
- The purpose and character of the use
- The nature of the copyrighted work
- The amount used in relation to the whole work
- The effect on the market for the original work
Fair use determinations are complex. When in doubt, seek legal advice.
False Claims Warning
Warning: Filing false DMCA claims is a serious matter. Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing may be liable for damages. Do not file claims for content you do not own or are not authorized to protect.
